Freelancers — designers, developers, writers, consultants, marketers and tutors — often ask the same question: "Do I need GST?" The answer depends mainly on your turnover, and on whether you work with Indian clients, foreign clients, or both.
When GST registration is mandatory
You must register for GST when your aggregate turnover in a financial year crosses:
| Where you are based | Threshold for service providers |
|---|---|
| Most states and UTs | ₹20 lakh |
| Special category states (Manipur, Mizoram, Nagaland, Tripura) | ₹10 lakh |
Aggregate turnover is the total value of all your supplies across India under the same PAN — including taxable, exempt and export services. It does not include GST itself.
Example: You earn ₹12 lakh from Indian clients and ₹10 lakh from foreign clients in a year. Your aggregate turnover is ₹22 lakh, so you must register.
Common mix-up: the ₹40 lakh threshold you may have heard of applies only to businesses supplying goods (in most states). For freelance services, the limit is ₹20 lakh.
What about clients in other states or abroad?
- Clients in other states: Service providers making inter-state supplies do not need to register until they cross the threshold.
- Foreign clients: Export of services is also allowed without registration below the threshold. But exports count towards your turnover.
Should you register voluntarily?
Registering before you cross the limit can make sense if:
- Your business clients in India prefer GST-registered vendors so they can claim input tax credit
- You work on platforms that ask for a GSTIN
- You export services and want to claim a refund of GST you pay on business expenses (see GST refund for freelancers)
- You buy costly business equipment and want to claim input tax credit
Remember, once registered, you must file returns regularly, even for months with no income.
GST rate for freelancers
Most freelance professional services — IT, design, consulting, marketing, content writing — are taxed at 18%. On an Indian invoice of ₹50,000, you charge ₹9,000 GST:
- Same-state client: 9% CGST + 9% SGST
- Other-state client: 18% IGST
Export of services and LUT
If you invoice foreign clients and meet the conditions for export of services (client outside India, payment received in foreign exchange or as permitted by RBI, place of supply outside India), the supply is zero-rated.
- File a Letter of Undertaking (LUT) on Form GST RFD-11 at the start of each financial year.
- With an LUT, you invoice without charging IGST.
- Mention on the invoice: "Supply meant for export under LUT without payment of IGST".
- Keep bank proof of foreign currency receipts (FIRC or bank advice).
We can file it for you — see our GST LUT filing service.
Reverse charge (RCM) for freelancers
Under reverse charge, you pay GST instead of the supplier in some cases. Common ones for registered freelancers:
- Import of services — for example, paying a foreign designer or agency for services used in your business
- Legal services from an advocate, if you are a registered business
Quick decision guide
| Your situation | GST registration needed? |
|---|---|
| ₹15 lakh a year, only clients in your own state | No |
| ₹15 lakh a year, clients in other states too | No (below the threshold) |
| ₹15 lakh a year, mostly foreign clients | No (below the threshold) — but optional if you want refunds |
| ₹22 lakh a year, mix of Indian and foreign clients | Yes — exports count towards turnover |
| ₹18 lakh a year, want to claim ITC on expenses | Optional — often worth it |
What if you don't comply?
- Late returns: a late fee of ₹50 a day (₹20 a day for nil returns), subject to caps
- Unpaid tax: interest at 18% a year
- Not registering when required: you may have to pay the GST you should have collected, plus interest and penalty
The department can see your turnover through TDS by clients, bank data and payment platforms, so it is better to register on time.
Returns you must file
- GSTR-1 — details of sales (monthly, or quarterly under QRMP if turnover is up to ₹5 crore)
- GSTR-3B — summary return and tax payment
- GSTR-9 — annual return, if your turnover requires it
Documents for GST registration
- PAN and Aadhaar
- Photograph
- Address proof of your work place (rent agreement, electricity bill, or owner's consent if working from home)
- Bank account details (cancelled cheque or statement)
- Mobile number and email

Only if your total turnover crosses the threshold (₹20 lakh in most states). Below it, registration is optional.
Can I use the composition scheme as a freelancer?
The service composition scheme has strict conditions, including no inter-state or export supplies. Most freelancers with clients outside their state or abroad cannot use it.
Does export income count towards the ₹20 lakh limit?
Yes. Export turnover is part of aggregate turnover.
What happens if I don't register after crossing the limit?
You may have to pay the tax that should have been collected, with interest and penalty. Register within 30 days of crossing the limit.
