What Is a Patent?

A patent is an exclusive legal right granted for an invention that is new, involves an inventive step, and is capable of industrial application. Registered under the Patents Act, 1970, it gives the inventor the sole right to make, use, sell or license the invention for 20 years from the date of filing, in exchange for publicly disclosing how the invention works. Filing involves a patentability search to check for existing prior art, drafting a specification with detailed claims, and responding to examination queries from the Indian Patent Office before the patent is finally granted. Patentability, examination and grant are governed by Sections 2(1)(j), 12 and 43 of the Patents Act, 1970.
